Terms and Conditions for Forklift Training Services

1. About These Terms
These Terms and Conditions apply to forklift training services provided by CONLIFT LTD (Company Number: 17130322), trading as Conlift Training ("Conlift", "we", "us", "our").
Registered office: 44 Colossus Way, Bletchley, Milton Keynes, Buckinghamshire, United Kingdom, MK3 6GW.
By booking training with us, you (the "Client") agree to these Terms on behalf of yourself, your business, and all delegates attending the training.
2. Definitions
Client: any individual or organisation booking services from Conlift.
Delegate: any person attending a training session.
Instructor: a competent forklift instructor assigned by Conlift.
Training Services: theory and practical forklift operator training, assessment, refresher and conversion services.
On-Site Training: training delivered at the Client's premises.
Off-Site Training: training delivered at an approved training location.
3. Scope of Training Services
Conlift provides training support for the following categories, where booked:
- Counterbalance (B1/B2)
- Reach Truck (D1)
- PPT (A1/A2, A4/A5)
- Pivot Steer (P1)
- VNA Man Up
Delivery routes can include Novice, Experienced, Refresher and Conversion training.
4. Legal and Safety Framework
Training delivery is designed with reference to relevant UK health and safety requirements, including:
- Health and Safety at Work etc. Act 1974
- Provision and Use of Work Equipment Regulations 1998 (PUWER)
- Lifting Operations and Lifting Equipment Regulations 1998 (LOLER)
- HSE ACOP L117 guidance
Conlift is a training provider. Unless explicitly agreed in writing, Conlift is not acting as a statutory regulator or awarding authority.
5. Booking and Confirmation
Bookings are accepted by written confirmation (email, signed agreement or confirmed online enquiry).
Course dates, delegate numbers, category, location and commercial terms are confirmed in writing.
6. Fees and Payment
Fees are agreed at booking stage. Unless otherwise agreed in writing, invoices must be paid before training starts.
We may pause delivery or withhold certificates where payment is overdue. Statutory late-payment interest and recovery costs may apply to business debts under UK law.
7. Client Responsibilities (On-Site Training)
For on-site delivery, the Client must provide:
- safe and serviceable equipment suitable for training;
- current inspection and maintenance compliance where required by law;
- a safe practical area with suitable segregation and supervision;
- site-specific safety rules, known hazards and emergency arrangements;
- appropriate insurance cover for staff, site operations and equipment.
Conlift may stop or reschedule training if site conditions are unsafe.
8. Delegate Requirements and Conduct
Delegates must:
- follow all instructor safety instructions;
- wear required PPE and behave responsibly;
- not attend under the influence of alcohol or drugs;
- be fit to undertake practical operator training.
Conlift may remove a delegate from training where behaviour is unsafe or disruptive. In those circumstances, fees may remain payable.
9. Certification and Outcomes
Certificates or training records are issued only where delegates:
- attend required training sessions;
- complete practical/theory assessment requirements;
- meet competency standards for the booked course level.
Attendance alone does not guarantee certification. Employers remain responsible for workplace familiarisation, supervision and authorisation to operate.
10. Cancellations, Rescheduling and Non-Attendance
Consumer bookings: where legally applicable, cancellation rights under consumer law apply.
Business bookings: cancellation requests must be made in writing.
- More than 7 calendar days before start date: free reschedule or full refund of prepaid course fee.
- 3 to 7 calendar days before start date: 50% cancellation fee.
- Less than 72 hours before start date or non-attendance: 100% fee payable.
Substitute delegates may be accepted where suitable and agreed in advance.
If Conlift must reschedule due to instructor illness, severe weather, safety concerns or force majeure, we will offer alternative dates or refund prepaid fees for the affected session.
11. Data Protection and Privacy
We process personal data in line with UK GDPR and the Data Protection Act 2018. Data is used for booking, communication, training administration, certification records and legal compliance.

12. Liability
Nothing in these Terms excludes liability that cannot legally be excluded, including liability for death or personal injury caused by negligence.
Subject to that, Conlift's total liability for a specific booking is limited to the fees paid for that booking. We are not liable for indirect or consequential losses, including loss of profit or business interruption.
13. Force Majeure
Conlift is not liable for delay or non-performance caused by events outside reasonable control, including severe weather, utility outages, fire, flood, industrial disputes, governmental restrictions, or other force majeure events.
14. Governing Law and Disputes
These Terms are governed by the laws of England and Wales. Disputes shall be handled by the courts of England and Wales, unless mandatory law requires otherwise.
